01 Acceptance
By creating an account, accepting an invitation, or otherwise using MarketinQ (the "Service"), you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
02 Access & accounts
You're responsible for the accuracy of your account information, the security of your credentials, and the activity that takes place under your account or the accounts you administer (in an agency tier, this includes your team and client workspaces).
03 Acceptable use
Don't use MarketinQ to send unlawful, deceptive, or harmful content; to violate consent or anti-spam laws; to harvest or scrape contacts you don't have permission to message; or to interfere with the Service's operation or other users.
- Comply with applicable email and SMS regulations (CAN-SPAM, TCPA, GDPR, ePrivacy, etc.) for your jurisdictions.
- Maintain documented consent for the contacts you process through the Service.
- Don't attempt to bypass approval controls or audit logging.
04 Your content
You retain ownership of the briefings, BrandProfile data, contacts, copy, assets, and other content you submit or generate ("Your Content"). You grant us a limited license to host, process, and operate on Your Content solely to provide the Service.
05 AI outputs
The Service produces AI-assisted drafts, suggestions, and proposed actions ("AI Outputs"). AI Outputs are starting points for your review — not finished work. You are responsible for reviewing, editing, and approving AI Outputs before they are published, sent, or acted upon.
We do not warrant that AI Outputs are accurate, complete, or fit for a particular purpose. Approval rules and the manual-first default exist to give you the final word.
06 Fees, billing & payments
Fees, billing cadence, and usage limits will be set out in your subscription. Early access pricing and terms are provided to participating accounts during onboarding.
Payments you collect from your customers. MarketinQ lets you collect payments — for example through payment links — using a payment provider you connect, such as Stripe. For those transactions, you connect and remain responsible for your own payment account, and funds settle to that account. FINDEQ LLC is not a party to the transaction, is not the merchant of record, and does not act as a payment processor or escrow agent. You are responsible for the goods or services you sell, and for taxes, refunds, chargebacks, disputes, and compliance with your payment provider's terms. Where no live payment provider is connected, a payment request may be recorded as pending and no funds are captured.
07 Early access
MarketinQ is in early access. Features may evolve, be deprecated, or be temporarily limited. Service-level commitments are best-effort during early access. Material changes will be communicated to your account.
Early access participants get locked-in launch pricing on the published tier they joined under, subject to the terms of their early access agreement.
08 Intellectual property
The Service, including the software, design, branding, and content authored by us, is owned by FINDEQ LLC and protected by intellectual property laws. We grant you a non-exclusive, non-transferable license to use the Service while these Terms are in effect.
09 Term & termination
These Terms apply while you use the Service. Either party may terminate the agreement under the conditions in your subscription. On termination, you can export Your Content during a 30-day grace period (see Privacy > Retention).
10 Disclaimers
The Service is provided "as is" and "as available." We disclaim all implied warranties to the extent allowed by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11 Limitation of liability
To the maximum extent permitted by law, FINDEQ LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or in connection with the Service. Total aggregate liability will not exceed the fees you paid for the Service in the twelve months preceding the claim.
12 Governing law
These Terms are governed by the laws of the jurisdiction in which FINDEQ LLC is registered, without regard to conflict of law principles. Disputes will be resolved as set out in your subscription agreement.
13 Changes
We may update these Terms as the Service evolves. Material changes will be communicated to account holders before they take effect. Continued use after the effective date constitutes acceptance.
